TERMS AND CONDITIONS GOVERNING THE USE OF myREMIT CASH CARD
 
1. Definitions
 
1.1 The myREMIT Cash Card (“myREMIT Cash Card”) is a pre-paid, non-interest earning, re-loadable debit card manufactured and issued by Chinatrust (Philippines) Commercial Banking Corporaton (“Chinatrust”) and branded by E-Money Plus, Inc. (“EMPI”) as the “myREMIT Cash Card”.
 
1.2 The myREMIT Cash Card does not have a corresponding bank account, and its Stored Value, as defined herein, is not considered as a bank deposit. The Stored Value does not earn interest, rewards or similar incentives convertible to cash, nor be purchased at a discount.
 
1.3 The myREMIT Cash Card is for the exclusive use of the Cardholder, and is not transferrable.
 
2. Application
 
2.1 An interested person may apply for the myREMIT Cash Card by properly filling out the Application Form (the “Applicant”) and paying a fee of One Hundred Fifty Pesos (Php150.00) (the “Application Fee”).
 
2.2 Applicant shall furnish EMPI with true, accurate, current and complete information as required under the Application Form, and as may be requested by EMPI from time to time for the purpose of establishing the identity of the Applicant and/or in compliance with any and all applicable laws.
 
2.3 If Applicant is a minor, he/she must be at least 13 years old to apply for a myREMIT Cash Card. He/she and his/her parent or legal guardian shall both sign the application form.
 
2.4 EMPI reserves the right to impose the submission of documents and/or proof of identity from Applicant in support of the Application form, including but not limited to a photocopy of Applicant’s valid identification card (“ID”).
 
2.5 EMPI reserves the right to revise the Application Fee, Replacement Fee and/or Renewal Fee, as defined herein, or to impose and/or revise any other applicable fees and charges at any time prior to or during the validity of the myREMIT Cash Card, upon notice at the myREMIT website or through any other means as may be determined by EMPI. Cardholder authorizes Chinatrust to debit his myREMIT Cash Card’s Stored Value for said fees and/or charges.
 
2.6 EMPI may refuse to issue a myREMIT Cash Card to Applicant, or to reject or suspend his application on any ground to be determined solely by EMPI.
 
2.7 Only one (1) myREMIT Cash Card may be applied for and granted to every Applicant.
 
3. Validity of the myREMIT Cash Card.
 
Once issued, a myREMIT Cash Card is valid for five (5) years from date of issuance, as indicated on the myREMIT Cash Card, unless terminated by EMPI or by Cardholder in accordance herewith.
 
4. Use
 
4.1 After submission by Applicant of all required information and documents in support of his application, and provided that the application has been approved by EMPI and the myREMIT Cash Card has been activated, the Applicant (now the “Cardholder”) may use the myREMIT Cash Card for the following:
 
a. To purchase goods and services at the point-of-sale (POS) in any and all Chinatrust, BancNet, Megalink, Expressnet and VISA affiliated  merchants (“Merchant”);
 
b. To purchase goods and services from any VISA-affiliated Merchant at any website;
 
c. To withdraw money from automated teller machines (“ATM”) of Chinatrust without service fees/charges, and from BancNet, Megalink, Expressnet and VISA affiliated ATMs subject to applicable service fees/charges;
 
d. To pay utility bills via the internet facility of Bancnet; and,
 
e. To check the Stored Value balance through any ATM of Chinatrust without service fees/charges, and from BancNet, Megalink and Expressnet ATMs subject to applicable service fees/charges;
 
f.  To use other facilities that Chinatrust may offer in the future for use of the Card, either through ATMs, computer system, or the internet. (collectively, “myREMIT Cash Card Transactions”).
 
4.2 Use of the myREMIT Cash Card shall be subject to sufficiency of the myREMIT Cash Card’s Stored Value, the Merchant’s ability to obtain the necessary verification, active or online status of the Merchant or ATM and active status of the myREMIT Cash Card (i.e.. not blocked or deactivated in accordance with these Terms and Conditions).
 
4.3 Use of the myREMIT Cash Card shall be subject to the daily aggregate transaction limit of Fifty Thousand Pesos (Php50,000.00) (“Daily Transaction Limit”).
 
4.4 The myREMIT Cash Card shall be for the Cardholder’s personal use only. EMPI reserves the right to initiate blocking or deactivation of the myREMIT Cash Card and/or to terminate its services and/or to initiate termination of Chinatrust’s services in connection with the myREMIT Cash Card, should it receive information or suspect that the myREMIT Cash Card is used by any person other than the Cardholder and/or for any other purpose not expressly allowed or is prohibited herein (“Unauthorized Use”) and/or for any purpose in violation of applicable laws (“Illegal Use”) or at any other time or for any other purpose as may be determined by EMPI.
 
4.5. Cardholder understands and agrees that use of the myREMIT Cash Card in stores which are not affiliated with Chinatrust, BancNet, Megalink, Expressnet or VISA is an Unauthorized Use thereof, which may damage the myREMIT Cash Card or impair its use.
 
4.6 The myREMIT Cash Card is not a credit card. Thus, Cardholder cannot stop payment on or reverse any Credit Card Transaction.
 
4.7 Use of the myREMIT Cash Card to purchase goods or services from a Merchant is governed by the terms and conditions of such purchase between Cardholder and Merchant. Consequently, Cardholder shall settle any refund, rebate, overpayment or underpayment with the Merchant, and not with EMPI. Cardholder agrees that EMPI shall not be liable for any and all claims, losses or damages arising from or connected to the purchase of goods or services or any of the myREMIT Cash Card Transactions provided herein.
 
5. Funding the myREMIT Cash Card 
 
5.1 The myREMIT Cash Card may be funded by (i) remittances sent to Cardholder through EMPI’s myREMIT services with the myREMIT Cash Card as the Pay-out Mode, or (ii) remittances made by the Cardholder or another person directly at EMPI’s myREMIT outlet/s (“Remittance-related Transactions”). The total amount remitted and/or credited to the myREMIT Cash Card constitute the myREMIT Cash Card’s stored value (“Stored Value”).
 
5.2 The myREMIT Cash Card may not be funded by depositing or remitting at Chinatrust, or through any ATM of or affiliated with Chinatrust, or by any means other than as provided herein.
 
5.3 The myREMIT Cash Card number shall be the basis for crediting the myREMIT Cash Card. Cardholder agrees that EMPI shall not be liable, and Cardholder shall indemnify and hold EMPI harmless for any claim, loss or damage arising from a discrepancy between the cash card number provided by a remitter and the cash card number of Cardholder’s myREMIT Cash Card.
 
5.4 No maintaining balance or minimum Stored Value is required for the myREMIT Cash Card.
 
5.5 Funds may not be transferred to or from the myREMIT Cash Card from or to another myREMIT Cash Card or other cash card, bank account or any other instrument or facility. 
 
5.6 The maximum aggregate loading limit of each myREMIT Cash Card per calendar month is P100,000.00 (“Monthly Loading Limit”). If the Monthly Loading Limit of a myREMIT Cash Card is reached, the excess amount shall be credited to the Cardholder’s myREMIT Cash Card in the following month, unless EMPI receives instructions from the remittance company which referred the remittance to EMPI for fulfillment (“Remittance Tie-up”) to deliver the remittance through EMPI’s other myREMIT Pay-Out Services (i.e. Door-to-Door, Cash Pick-up or Credit-to-Bank).
 
5.7 Should Cardholder have any question on a Remittance-related Transaction, Cardholder may call EMPI’s Customer Service at 410-4000. 
 
6. Fees and Charges
 
6.1 EMPI’s Application Fee. EMPI’s Application Fee, as defined above, shall be charged to Cardholder at EMPI’s discretion.
 
6.2 myREMIT Cash Card Transaction–related Fees/Charges.
 
Chinatrust has the right to deduct from the outstanding value of the Card any transaction fees in such amount of standard ATM charges and fees for any transaction without the need of prior written notice to the Cardholder.

6.3 Corresponding ATM and Visa charges shall be debited from the Card’s outstanding value.
 
6.3.1 All ATM, BancNet Online, VISA, Bank’s NetBanking, and Point-of-Sale fees (if any) shall apply.
 
6.3.2 International ATM fees and charges
 
The following transaction fees shall be imposed on all ATM transactions outside the Philippines or at non-BancNet defined ATMs, non-Megalink defined ATMs, non-Expressnet accredited and at all Visa-member ATMs in the Philippines:
 
6.3.3 US$ 3.50 for ATM transactions approved;
6.3.4 US$ 1.50 for ATM balance inquiry;
6.3.5 US$ 1.00 for ATM transaction declined for reason of insufficient funds or exceeds daily balance.
 
All US Dollar-denominated charges will be charged in its Peso equivalent. Exchange rate from U.S. Dollar to Philippine Peso will be adjusted monthly.
 
Ang mga transaksyon na ginawa gamit ang ibang currency maliban sa Philippine Peso ay may kaukulang palitan at bibigyan ng katumbas na halaga ito sa Philippine Peso. Ang halaga ng palitan na gagamitin ay maaaring maiba mula sa halaga ng palitan sa petsa ng transaksyon. 
 
6.4 Replacement Fee and Renewal Fee.
 
A fee of One Hundred Fifty Pesos (P150.00) per Cash Card shall be charged to Cardholder for the issuance of a replacement and/or renewal of the myREMIT Cash Card, as appropriate, except for defective myREMIT Cash Cards which have not been used by Cardholder for any of the Cash Card Transactions. The Replacement Fee / Renewal Fee is debited from the Stored Value of the myREMIT Cash Card   EMPI reserves the right to increase the Replacement Fee/ Renewal Fee, from time to time, upon notice to Cardholder on the myREMIT website or through other means as may be determined by EMPI.
 
6.5 Other fees/charges.
 
Other fees/ charges may be imposed on Cardholder by the respective Merchant for purchase of goods or services.
  
7. Responsibilities of Cardholders
 
7.1 Cardholder is responsible for the care, security and safety of the myREMIT Cash Card, the Cash Card number, personal
identification number (“PIN”), and password.
 
7.2 The Cardholder undertakes to sign the myREMIT Cash Card upon receipt thereof. For purchases at BancNet and Visa-affiliated merchants, EMPI and Chinatrust shall not be held liable to the Cardholder for any discrepancy between the Cardholder’s signature appearing on the Card and the corresponding sales slip for any reason (s) that the Card is not honored.
 
7.3 Cardholder shall not allow any other person to use the myREMIT Cash Card, and shall not disclose the PIN to any person at any time and under any circumstance.
 
7.4 Cardholder shall immediately report to Chinatrust in case the security and confidentiality of the PIN or password is compromised or breached, whether actual, suspected or threatened, in the same manner as reporting a lost, stolen, captured, defective or damaged myREMIT Cash Card provided herein.
 
7.5 Cardholder is responsible for checking any and all fees or charges imposed for a myREMIT Cash Card Transaction.
 
7.6 Cardholder is responsible for checking the Stored Value of the myREMIT Cash Card and for ensuring the sufficiency of its Stored Value before undertaking any myREMIT Cash Card Transaction.
 
7.7 Cardholder is responsible for informing any and all of his remitters of the following : (i) the myREMIT Cash Card number, (ii) the fact that the myREMIT Cash Card is lost, stolen, captured, defective or damaged, (iii) the fact that his myREMIT Cash Card is blocked or deactivated; (iv) the issuance of a new myREMIT Cash Card to Cardholder, and the new myREMIT Cash Card’s corresponding myREMIT Cash Card number. Cardholder shall indemnify and hold EMPI free and harmless from any and all claims, losses or damages arising from EMPI’s refusal or failure to credit any remittance to a myREMIT Cash Card which has been (i) blocked pursuant to Cardholder’s report that it was lost, stolen, defective or damaged in the manner provided herein, or (ii) blocked due to Unauthorized or Illegal Use; (iii) deactivated due to expiry or termination; or (iv) otherwise blocked or deactivated for other reasons solely determined by EMPI.
 
8. Reporting, Blocking and Replacement of Lost/ Stolen/Captured/Defective/Damaged Cards or Cards used in an Unauthorized or Illegal Manner
 
8.1 Cardholder shall report immediately to Chinatrust in case his myREMIT Cash Card is lost, stolen, captured, defective, damaged or used in an Unauthorized or Illegal manner by calling Chinatrust’s 24/7 Customer Care at (632) 840-1234 or 1 800 10 840-1234 (Domestic Toll-Free Number.) (the “Cardholder’s Report”)
 
8.2 Only the Cardholder may report to Chinatrust that his lost, stolen, defective or damaged myREMIT Cash Card.
 
8.3 Cardholder may report a myREMIT Cash Card that has been captured by an ATM, without retrieving the same. This will be treated as a lost card, for which a notarized affidavit of loss shall be submitted.
 
8.4 The myREMIT Cash Card shall be blocked by Chinatrust upon receipt of Cardholder’s Report.
 
8.5 A myREMIT Cash Card, once blocked, may not be unblocked, unless the Cardholder requested a temporary blocking in case of a lost myREMIT Cash Card, in which case it may be unblocked upon subsequent request of the Cardholder by calling Customer Care.
 
8.6 The Cardholder shall indemnify and hold EMPI, its parent and affiliated companies, and trusted service providers, their officers, directors, employees and representatives, free and harmless from any and all claims, suits, damages, or liabilities which may arise out of or in connection with reporting or blocking the myREMIT Cash Card as provided herein.
 
9. Replacement myREMIT Cash Card
 
9.1 During the Cardholder’s Report, Cardholder shall advise Chinatrust if he/she requests the issuance of a new myREMIT Cash Card to replace the lost, stolen, captured, defective or damaged myREMIT Cash Card (“Replacement myREMIT Cash Card”).
 
9.2 In case of a lost or stolen myREMIT Cash Card, Cardholder shall submit a duly signed and notarized Affidavit of Loss to EMPI or its authorized representative upon delivery of the Replacement myREMIT Cash Card. Without submission of the Affidavit of Loss, the Replacement myREMIT Cash Card shall not be activated.
 
9.3 In case of a defective or damaged myREMIT Cash Card, Cardholder shall surrender the defective or damaged myREMIT Cash Card to EMPI or its authorized representative upon delivery of the Replacement myREMIT Cash Card. Without surrender of the defective or damaged myREMIT Cash Card, the Replacement myREMIT Cash Card shall not be activated.
 
9.4 The issuance of a Replacement myREMIT Cash Card is subject to payment of the Replacement Fee as provided above. The Replacement Fee is not applicable in case of a defective myREMIT Cash Card, provided the defective myREMIT Cash Card has not been previously used for a myREMIT Cash Card Transaction.
 
9.5 Any remaining Stored Value in the lost/stolen/defective/damaged myREMIT Cash Card at the time of blocking shall be transferred to the Replacement myREMIT Cash Card. If Cardholder did not request for issuance of a Replacement myREMIT Cash Card, the remaining Stored Value shall be delivered by EMPI to Cardholder through Cardholder’s preferred Pay-out Mode as expressed by Cardholder to EMPI, subject to deduction of any and all applicable fees and charges.
 
9.6 The Cardholder agrees to render assistance to and cooperate with Chinatrust, EMPI, or the relevant authorities in case of a lost or stolen myREMIT Cash Card, or in case of Unauthorized or Illegal Use of a myREMIT Cash Card.
 
9.7 EMPI reserves the right to solely determine valid grounds for issuance of a Replacement myREMIT Cash Card aside from those indicated herein.
 
10. Voluntary termination of myREMIT Cash Card by Cardholder.
 
10.1 Cardholder may voluntarily request termination of the myREMIT Cash Card by calling Chinatrust’s 24/7 Customer Care at (632) 840-1234 or 1 800 10 840-1234 (Domestic Toll-Free Number.)
 
10.2 Chinatrust shall deactivate the myREMIT Cash Card upon receiving Cardholder’s request.
 
10.3 Any remaining Stored Value in the myREMIT Cash Card at the time of deactivation shall be delivered by EMPI to Cardholder through Cardholder’s preferred Pay-out Mode (i.e. Door-to-Door, Credit-to-Bank or Cash Pick-up) as expressed by Cardholder to EMPI, subject to deduction of any and all applicable fees and charges.
 
11. Renewal myREMIT Cash Cards
 
11.1 The myREMIT Cash Card is deactivated on the date of its expiry.
 
11.2 At any time prior to the expiration of the myREMIT Cash Card, EMPI shall call the Cardholder to confirm if he wants a renewal myREMIT Cash Card issued to him.
 
11.3 If the Cardholder expresses his/her preference for a renewal myREMIT Cash Card.
 
11.3.1 Cardholder shall surrender the expired myREMIT Cash Card upon delivery of the renewal myREMIT Cash Card by EMPI or its authorized representative. Without surrender of the expired myREMIT Cash Card, the renewal myREMIT Cash Card shall not be activated.
 
11.3.2 Any remaining Stored Value as of deactivation of the expired myREMIT Cash Card shall be transferred to the new myREMIT Cash Card.
 
11.3.3 The new myREMIT Cash Card shall be valid for five (5) years from the date of its issuance, as indicated on the myREMIT Cash Card.
 
11.4 If the Cardholder does not want a renewal myREMIT Cash Card issued to him/her, EMPI shall deliver any remaining Stored Value upon deactivation of the expired myREMIT Cash Card via Cardholder’s preferred Pay-out Mode (i.e. Credit-to-Bank, Cash Pick-Up or Door-to-Door), as expressed to EMPI.
 
12. Personal Identification Number (“PIN”)
 
12.1 The PIN refers to the 4-digit Personal Identification Number issued to or selected by Cardholder under these Terms and Conditions in order that the myREMIT Cash Card may be used to withdraw or check the Stored Value of the myREMIT Cash Card at any Chinatrust, Bancnet, Megalink, Expressnet or Visa -affiliated ATMs, subject to the respective terms and conditions governing the use of the affiliated ATM. 
 
12.2 The PIN may be changed by Cardholder at any of Chinatrust’s ATMs subject to conditions, which may be imposed by Chinatrust on use of the ATM and after validation by Chinatrust’s system. 
 
12.3 The Cardholder acknowledges that the PIN is for his exclusive use and is strictly confidential and shall at no time and under any circumstances be disclosed to any person. 
 
12.4 The Cardholder shall in all circumstances have full responsibility for all transactions arising out of the use of the Card and PIN whether or not transacted with his knowledge or authority.
 
12.5 In the event that the Cardholder forgets his/her PIN, the Cardholder may apply for a replacement myREMIT Cash Card with Chinatrust under the same procedure provided in Section 9 above, provided that Cardholder surrenders his/her old myREMIT Cash Card to EMPI upon EMPI’s delivery of the replacement myREMIT Cash Card to Cardholder
 
13. Force Majeure.
 
Cardholder understands and agrees that EMPI may suspend the grant of an application for the issuance of a myREMIT Cash Card, and EMPI may initiate, and/or Chinatrust may undertake on its own, the suspension of the use of the myREMIT Cash Card in case of any
act of God, governmental acts, civil commotion, riots, strikes, war, fire, flood, explosions, acts of terrorism, mechanical failure, power failure, malfunction, interruption or inadequacy of equipment or installation, or by reason of any other act, matter or thing beyond EMPI’s and Chinatrust’s reasonable control.
 
14. Insurance. 
 
The myREMIT Cash Card does not represent and shall not be deemed as a bank or deposit account, but funds credited or loaded to the myREMIT Cash Card are bills payable of the bank.
 
myREMIT Cash Cards may only be used at face value. It shall not earn interest or rewards and other similar incentives convertible to cash, nor be purchased at a discount. myREMIT Cash Card is not considered a deposit hence it is not insured with the Philippine Deposit Insurance Corporation.
 
Ang myREMIT Cash Card ay hindi nagbibigay ng interest, puntos o insentibo at ang halagang magagamit ay limitado lamang sa pondo na naka-load sa myREMIT Cash Card. Hindi rin maaaring bumili ng mas mababa sa halaga na nakalagay sa myREMIT Cash Card. Hindi maaaring ipalit sa pera ang myREMIT Cash Card at hindi ito isang deposito kung kaya hindi ito sakop ng Philippine Deposit Insurance Corporation.
 
15. Compliance with Existing Laws
 
15.1 The Cardholder hereby warrants that his/her use of the myREMIT Cash Card does not and will not violate any applicable provisions of law, rules and regulations, including but not limited to the Anti-Money Laundering Law. 
 
15.2 These Terms and Conditions may be amended by EMPI from time to time,
which amendment shall take effect as stated therein.
 
16. Non-liability and Indemnification. 
 
16.1 Cardholder shall indemnify and hold Chinatrust and EMPI free and harmless from and against any cost, loss, expense or liability incurred by or as a consequence of the improper, fraudulent or illegal use of the Card, such as tampering, usage of the Card by unauthorized persona and other similar or analogous circumstances.
 
16.2 Chinatrust and EMPI shall not be liable for any loss or damage of whatever nature in connection with transactions involving the Cardholder’s use of the Card, resulting in loss or damage which the Cardholder may suffer arising out of any fraudulent or unauthorized utilization of the Card due to theft or unauthorized disclosure of PIN/Username/Password or violation of other security measures with or without the Cardholder’s participation and/or arising out ot authorized/unauthorized use of the card, and/or loss or damage arising out of compromised account, card skimming (i.e. illegal copying of information from the magnetic strip or a credit or debit card, like the Cash Card) and use of skimmed Card.
 
16.3 Cardholder shall indemnify and hold Chinatrust and EMPI, its parent, and affiliated companies, their officers, directors, employees and agents, free and harmless from any and all claims, liability, suit, loss, damages and costs arising from or connected to the Cardholder’s breach or violation of any of the obligations, responsibilities, warranties of the Cardholder and other provisions in these Terms and Conditions, or any and all applicable law, rules or regulations in connection with the application for, issuance, funding and use of the myREMIT Cash Card.
 
16.4 Cardholder shall indemnify and hold EMPI, its parent, and affiliated companies, their officers, directors, employees and agents,free and harmless from and against any claims, liability, suit, loss, damages and costs arising from or connected to any and all myREMIT Cash Card Transactions as provided herein.
 
16.5 Cardholder shall indemnify and hold Chinatrust and EMPI, its parent, and affiliated companies, their officers, directors, employees and agents, free and harmless against any and all claims, liability, suit, loss, damages and costs arising from or connected to the purchase of goods and/or services with affiliated Merchants. Without limiting the generality of the foregoing, EMPI, its parent, and affiliated companies, their officers, directors, employees and agents, shall not be liable for any claims, liability, suit, loss, damages and costs arising from or connected to a Merchant/merchant’s refusal or failure to honor the myREMIT Cash Card, or the rejection of a myREMIT Cash Card Transaction for any reason including but not limited to a discrepancy between the Cardholder’s signature appearing on the myREMIT Cash Card and the Cardholder’s signature as it appears on the corresponding sales slip for POS transactions. 
 
16.6 Neither EMPI nor Chinatrust shall be liable for any loss, damage, liability, claim or suit which may be suffered or incurred by the Cardholder as a result of non-renewal of an expired myREMIT Cash Card.
 
16.7 EMPI shall not be liable to Cardholder for services directly provided by Chinatrust in connection with the myREMIT Cash Card, including but not limited to receiving Cardholder’s Report for lost, stolen, captured, defective or damaged myREMIT Cash Cards or myREMIT Cash Cards used in an Unauthorized or Illegal manner; blocking of myREMIT Cash Cards, confirmation of Cardholder’s request for a Replacement myREMIT Cash Card,  and verification of Cardholder’s identity reporting the lost/stolen/captured/defective/damaged myREMIT Cash Card and making the request for a Replacement myREMIT Cash Card.
 
17. Amendments. 
 
EMPI reserves the right to amend or modify the Terms and Conditions herein from time to time, including but not limited to instances where such amendments are necessary in compliance with changes in the relevant laws or regulations governing the product. Cardholder agrees to be bound by such amendment or modification.
 
18. Governing Law.
 
The laws of the Republic of the Philippines shall govern these Terms and Conditions.
 
ADDITIONAL TERMS AND CONDITIONS FOR THE USE OF THE  myREMIT CASH CARD
 
The following terms and conditions, in addition to the foregoing, shall apply with regard to the use of the  myREMIT Cash Card.
 
1. Usage of the Card.
 
The Cardholder expressly agrees that the use of the myREMIT Cash Card is at his/her own risk and he/she shall assume all risk or delays incidental to or arising out of the use of the myREMIT Cash Card. The Cardholder, therefore, accepts Chinatrust’s record of these transactions as conclusive and binding upon him/her in all aspects. The Cardholder/Depositor shall not hold Chinatrust liable for any loss, damage or injury arising from the use of the myREMIT Cash Card however casual including but not limited to mechanical defect or malfunction of the ATMs or of the myREMIT Cash Card not being honored.
 
2. Bills Payment. 
 
When accepting Bills Payment, Chinatrust merely acts as a conduit of the Cardholder and the Payee of the bill. As such, Chinatrust shall not be answerable for discrepancies committed by the Cardholder nor shall Chinatrust be held liable for any action, which may arise, between the Payee and the Cardholder. The Cardholder further agrees to bind himself and undertake to indemnify and free Chinatrust from any and all losses, claims and damages, liabilities, fees, expenses etc. arising from the acceptance of bills payments thru the ATM.
